Independent Photographic Supplies Pty Ltd ACN 105 600 351 ("iPhoto" “we” “us”) appreciates the importance of protecting an individual’s personal information.  We are committed to protecting and maintaining the privacy, accuracy and security of your personal information.

iPhoto’s privacy policy complies with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) as amended from time to time (‘Privacy Act’) and explains how your personal information and credit related information will be managed when dealing with iPhoto.

While the Privacy Act uses a variety of terms to refer to the personal information and consumer-credit related information, we refer to such information as ‘personal information’.

When you engage iPhoto to provide you with any goods or services, applying for commercial credit, or communicate with iPhoto through email, by telephone, in writing, or use any of iPhoto’s other services, including the our websites, you agree to the use and disclosure of your personal information in the manner described in this policy.

If you do not accept iPhoto’s privacy policy then you should not provide any personal information to us.

What information does iPhoto collect?

We will only collect personal information relevant to our business relationship with you.

Some examples of the personal information we may collect, include:

(i)        identity particulars such as; your name, sex, address, date of birth, telephone number, occupation, and drivers licence number;

(ii)       your bank account details and credit card information;

(iii)      financial information;

(iv)     email, user ID's and passwords;

(v)      any goods, services or commercial credit provided to you;

(vi)     information about your transactions with us, such as account balances, payment history and account activity;

(vii)    records of your communications with us;

(viii)   court proceedings information, personal insolvency information and credit-related publicly available information;

(ix)     personal website usage information.

How we collect your personal information

iPhoto will only collect personal information by lawful and fair means.

Where practicable we will collect personal information directly from you. We may also collect your personal information through our website, by e-mail, telephone or written correspondence, or from third parties such as credit reporting bodies to the extent required to assess your application for credit in providing you with the product or service on credit.

Why we collect and use your personal information

We will generally collect and use your personal information for the primary purpose of:

(i)            our general business operations;

(ii)           providing you with our goods and services;

(iii)          communicating with you;

(iv)          responding to your inquiries about our goods and services;

(v)           for administering, monitoring, evaluating and managing the credit arrangement you have with us;

(vi)          to collection of payments under your credit arrangement, internal accounting and administration;

(vii)         meeting our legal and regulatory requirements;

(viii)        conducting, improving and developing a business relationship with you;

(ix)          marketing (such as providing individuals with information about our products and promotional notices and offers); and

(x)          improving our website.

How we use and disclose your personal information

We will limit the use and disclosure of your personal information to:

(i)            the primary purpose for which it was collected, such as is described above;

(ii)           where you would reasonably expect this;

(iii)          where you have consented;

(iv)         fulfilling our legal requirements (for example, disclosure to law enforcement agencies of the courts).

(v)          for direct marketing by us (such as  to offer you products or services that we believe meet your needs and/or further information concerning our  e-Commerce facility), but giving you the opportunity to opt out of such direct marketing.  We include our contact details in any direct marketing.

At the point of collection, we will inform you of the use to which the information will be put and to whom we may disclose the information.

We will not disclose your personal information to any credit reporting body.

We will not disclose your personal information for any secondary purposes unless your consent has been given or as required by law.

Who will use your personal information?

We will not share, sell or trade your personal information. However, we may disclose your personal information to other select organisations ("Third Parties") who perform certain functions or operations for us.

In these situations we prohibit the Third Parties from using your personal information for any purpose other than the one for which it was supplied. We enforce this requirement through contractual arrangements with them. If you do not wish us to disclose your information to such Third Parties, you should contact our Privacy Officer.

If you prohibit us from disclosing your personal information to the Third Parties, we may not be able to deliver the product or service you request.

Your information is secure

iPhoto endeavors to use up-to-date techniques and processes to ensure that your personal information is kept secure and confidential.

 iPhoto has policies and procedures in place to prohibit our employees from looking at, recording, or disclosing your personal information except in the performance of their duties.

We will not retain any of your personal information for longer than it is required by us, except to fulfill our legal obligations. For example, although we do not store credit card number or expiry details in our databases, we will store the credit card approval information for reconciliation purposes. We also store the cardholder name for reference in the event of any disputed transaction.

When you submit your information on our website it is passed through our secure server using encryption technology (i.e. Secure Socket Layer encryption) which scrambles the information to protect it over the internet.

If you believe that the personal information that we hold is incorrect, incomplete or out-of-date please notify us in writing and we will take reasonable steps to correct the information, or if necessary, contact you to discuss an alternative arrangement.

You have access to your information

We acknowledge that you have a general right of access to information concerning you, and to have inaccurate information corrected. Unless exempted by the Act or by law, we may provide you with access to the personal information that we hold about you. To apply for access to your personal information we hold, you should submit a written request to our Privacy Officer with a certified copy of your driver’s licence or passport to prove your identity.

We will endeavour to respond to your request within 28 days of receipt of your request. We may recover from you our reasonable costs incurred in providing you with the information, such as copying charges, but not for making the request itself, but never for making the request itself. ., Before we act upon such request we will tell you how much we will charge.

Privacy and our Website

As with most websites, when you visit the iPhoto website or use an application on the iPhoto website, we may record anonymous information such as IP address, time, date, referring URL, pages accessed and documents downloaded, type of browser and operating system.

We also use “cookies”. A cookie is a small file that stays on your computer until, depending on whether it is a sessional or persistent cookie, you turn your computer off or it expires. Cookies may collect and store your personal information. You may adjust your internet browser to disable cookies.

If cookies are disabled you may still use iPhoto’s website, but the website may be limited in the use of some of the features.

The iPhoto website may also contain links to or from other websites. iPhoto is not responsible for the privacy practices of other websites. This privacy policy applies only to the information we collect on the iPhoto’s website. We encourage you to read the privacy policies of other websites you link to from iPhoto’s website.

Anonymity when dealing with iPhoto

iPhoto allows individuals the option not to identify themselves when dealing with us, only where it is practicable.

Dealing with unsolicited information

iPhoto take all reasonable steps to ensure that all unsolicited information is destroyed immediately.

Cross border disclosure

Any personal information provided to us may be transferred to, stored by or disclosed to an overseas recipient. For example, we may use a server hosted overseas to store data, which may include your personal information. Your personal information may also be processed by, or disclosed to employees, representatives, or other third parties operating outside of Australia who work for, or are engaged by iPhoto in other countries.

iPhoto will take reasonable steps, in the circumstances, before your personal information is disclosed to an overseas recipient, to ensure that the overseas recipient does not breach privacy laws in relation to your personal information (‘the reasonable steps’).

The reasonable steps may not apply if you consent to the disclosure of your personal information to an overseas recipient and we reasonably believe that the overseas receipt is subject to laws that are suitability similar to privacy laws in Australia. 

If you consent to the disclosure of your personal information to an overseas recipient, the overseas recipient may not be accountable under the Privacy Act, and you will not be able to seek redress for breaches under the Privacy Act.

Collecting sensitive information

iPhoto does not collect sensitive information, unless it is specifically relevant and necessary for the purpose of our business operation and your consent is first obtained. All sensitive information that is collected is used in accordance with this privacy policy.

Government identifiers

We do not use government identifiers (e.g. tax file numbers, Medicare number) to identify individuals.

Complaints and disputes

We acknowledge that you have a general right to ensure your personal information and your credit related information is accurate and up-to-date as well as the general right of access to information concerning you, and to have inaccurate information corrected.  If you have reason to believe that we have not complied with our obligations relating to your information or the Privacy Act, please refer any compliant to our Privacy Officer (details below). We will ensure your compliant is handled by our Privacy Officer in an appropriate and reasonable manner. A written notice of our decision regarding your complaint will be provided to you.

Changes to our Privacy Policy

We may amend this statement and our privacy policy from time to time. Not all changes will require your consent. We will notify you of any change to our policy which requires your consent before implementing. A current version of this policy will be published on our website or may be obtained free of charge upon request.
